Terms of Service

For the purposes of these Terms:

• "Service" — the OLY – The Coach platform, including all features, tools, APIs, and integrations.
• "User" — any individual or entity accessing or using the Service.
• "User Content" — any data, input, or information submitted by the User.
• "AI Output" — any content generated by the Service.

OLY is an artificial intelligence-powered assistant designed to support basketball coaches in areas such as practice planning, player analysis, and decision-making. The Service does not provide medical advice, professional certification, or guaranteed outcomes. Due to the probabilistic nature of artificial intelligence, outputs generated by the Service may be inaccurate, incomplete, or inappropriate.

By using the Service, you acknowledge and agree that:

• AI-generated outputs are produced automatically and are not reviewed by humans.
• Such outputs should not be relied upon as the sole basis for any decision, including coaching decisions, player development strategies, or physical training plans.
• You assume full responsibility for evaluating and using any output generated by the Service.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Attempt to reverse engineer, decompile, or otherwise extract the underlying models or source code.
• Scrape, harvest, or extract data at scale, or use the Service to train competing AI systems.
• Generate illegal, harmful, abusive, or misleading content.
• Attempt to bypass any security measures, rate limits, or system restrictions.

Any violation may result in immediate suspension or termination of your access.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. OLY shall not be held liable for any unauthorized access resulting from your failure to safeguard your account information.

You represent and warrant that you have all necessary rights to submit any User Content to the Service. By submitting such content, you grant OLY a non-exclusive, worldwide, royalty-free license to use, process, and store your data solely for the purposes of operating, maintaining, and improving the Service.

OLY may also use anonymized and aggregated data to enhance system performance and train its AI models. Personal data is handled in accordance with applicable data protection laws and is not sold to third parties.

You retain ownership of your User Content and any AI Outputs generated by the Service. However, OLY retains all rights, title, and interest in and to the platform, including its underlying technology, models, algorithms, and design. No rights are granted to you except those expressly stated in these Terms.

The Service may offer free access, subscription-based plans, or token-based usage models. All payments are made in advance and are non-refundable unless otherwise required by applicable law. Subscriptions may renew automatically unless canceled prior to the renewal date. OLY reserves the right to modify pricing and service features at any time.

Certain features of the Service may be labeled as beta or experimental. These features may be unstable, subject to change, or discontinued without prior notice and are provided without any guarantees of performance or reliability.

OLY does not guarantee that the Service will be uninterrupted, secure, or error-free. The Service may be unavailable from time to time due to maintenance, updates, or technical issues.

To the maximum extent permitted by law, OLY shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of data, personal injury, or any decisions made based on AI-generated outputs.

In any case, the total liability of OLY shall not exceed the total amount paid by the User for the Service during the twelve months preceding the claim.

You agree to defend, indemnify, and hold harmless OLY, its affiliates, and its partners from and against any claims, damages, liabilities, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party rights.

The Service may include integrations or links to third-party services. OLY is not responsible for the availability, security, or data practices of such third-party services, and your use of them is at your own risk.

You are responsible for ensuring the security of your devices and access points. OLY reserves the right to suspend or restrict access to accounts that exhibit suspicious or unauthorized activity.

OLY may suspend or terminate your access to the Service at any time, without prior notice and without refund, particularly in cases of violation of these Terms. OLY may also delete associated data where permitted by law.

You must be at least 18 years of age to use the Service, or have the consent of a parent or legal guardian.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, fitness for a particular purpose, or non-infringement.

OLY shall not be held responsible for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, governmental actions, or failures of telecommunications or infrastructure systems.

OLY reserves the right to modify these Terms at any time. Continued use of the Service after such modifications constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Greece. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Athens.
